Court Dismisses KCC's Injunction Request to Suspend EBS President Kim Yuyul

[Alpha Biz= Kim Jisun] On May 26, the Goyang Branch of the Uijeongbu District Court dismissed an injunction request filed by the Korea Communications Commission (KCC) and independently participating party Lee Jin-sook, Chairperson of the KCC, to suspend the duties of Kim Yuyul, President of EBS.



The court ruled that the application was procedurally invalid, stating that it was filed by a legal representative lacking proper authority. According to relevant laws, only the Minister of Justice may represent the Republic of Korea in lawsuits involving the state, and only the Minister may appoint an attorney as legal counsel in such cases.



Even if the lawsuit had been filed properly, the court noted that Kim Yuyul was fulfilling his role in accordance with the Korea Educational Broadcasting System Act, as the appointment of Shin Dong-ho as the new president had been suspended by a separate court ruling. Therefore, the court found insufficient grounds to conclude that the KCC’s authority to appoint the EBS president had been infringed upon.



The KCC originally filed the injunction request last month after the Seoul Administrative Court suspended the appointment of Shin Dong-ho as EBS president. This decision allowed Kim Yuyul to return to his post, prompting the KCC to seek a separate legal avenue to block his reinstatement.
