Seoul Semiconductor announced on Thursday that the District Court of Düsseldorf, Germany, issued an immediate sales ban on all "patent-infringing products" sold by retailer Conrad Electronic. The court also ordered the recall and destruction of lighting products utilizing the patented technology sold by Philips from March 2017 to the present.
This ruling took effect after Germany's Patent Court upheld the validity of Seoul Semiconductor's patent on December 17. Typically, product recall and destruction orders follow the validation of a patent dispute, but in this case, the sequence of rulings was reversed.
Violating the order could result in fines of up to $250,000 per violation, a measure aimed at preventing future infringements, according to Seoul Semiconductor.
The company emphasized that the ruling pertains to core technology used in home and automotive lighting, as well as IT flash and backlight products, designed to achieve a color rendering index (CRI) of 70 or higher.
