Burger King Faces U.S. Lawsuit Over Allegedly Misleading Burger Advertisements

[Alpha Biz= Paul Lee] Florida, USA — May 6, 2025 — Burger King is set to face a lawsuit in the United States over allegations of false and misleading advertising. On May 5, a federal judge in Florida rejected Burger King's request to dismiss a class-action lawsuit originally filed in 2022.
According to USA Today, the case was brought by 19 consumers from 13 different U.S. states who claim that Burger King's advertisements misrepresented the size and contents of its burgers, particularly when compared to competitors.
The plaintiffs argue that the burgers featured in advertisements appear approximately 35% larger than the actual product, with beef patties styled to look more substantial and ingredients shown as more abundant than what customers actually receive.
The lawsuit demands that Burger King cease the sale of the allegedly exaggerated menu items, correct its advertising practices, and return profits gained through the misleading marketing.
In a motion filed in October 2023, Burger King denied wrongdoing, stating that the patties used in advertisements are identical to those served in restaurants. The company claimed that consumers failed to read menu descriptions properly and that the only difference was that the burgers in ads were “more beautifully styled” for presentation.
The case now moves forward, potentially setting a precedent in how food advertisements are regulated in the fast food industry.
