E-Land Retail lost its corporate tax refund suit of 1.2 billion won

[Alpha Biz=(Chicago) Reporter Kim Jisun] E-Land Retail filed an administrative lawsuit to refund about 1.2 billion won in corporate tax, but lost.
According to legal circles on the 2nd, the Seoul Administrative Court Administration Department 2 (senior judge Shin Myung-hee) ruled that E-Land Retail filed a claim against the head of Banpo Tax Office in Seoul to cancel the refusal of corporate tax correction.
E-Land Retail sold its fashion brand-related assets to its parent company E-Land World in 2014 for 51.1 billion won. Of the proceeds from the sale, 29.6 billion won was belatedly recovered between 2014 and 2016 and the rest in June 2017.
E-Land Retail also lent E-Land Construction 8.5 billion won in 2015 and 29.8 billion won in 2016, and paid 170 million won in advance for the construction of its branch in 2015.
The company asked for the return of the corporate tax it paid, saying it does not constitute a "business-related provisional payment" subject to taxation because it is directly related to business activities.
By business year, it requested a refund of 100 million won in 2015, 844 million won in 2016, and 316 million won in 2017.
When the Banpo Tax Office and the Tax Tribunal refused to accept all of them, they filed an administrative lawsuit, but the court's judgment was the same.
It was further supported by the fact that the Fair Trade Commission judged this to be unfair support and imposed a corrective order and fine in April 2022.
