Court Rejects President Yoon Suk-yeol’s Objection to Search and Seizure Warrant Execution

[Alpha Biz= Kim Jisun] A court has dismissed an objection filed by President Yoon Suk-yeol's legal team, requesting the suspension of the execution of a search and seizure warrant.

According to legal sources on Sunday, Judge Ma Sung-young of the Seoul Western District Court’s Criminal Division 7 denied the objection submitted by President Yoon’s legal representatives.

A court official stated, "The reasons for the dismissal require anonymization or summarization and cannot be disclosed at this time."

Earlier, on January 2, President Yoon’s legal team had raised concerns about the warrant's content, arguing that it violated constitutional protections. They pointed out that the phrase included in the warrant—"Articles 110 and 111 of the Criminal Procedure Act do not apply to this warrant"—contradicts Article 12 of the Constitution, which states, "No arrest, detention, search, or seizure shall be conducted except as provided by law."

Articles 110 and 111 of the Criminal Procedure Act stipulate that searches and seizures cannot be carried out in locations or on items related to military or official secrets without the consent of the responsible authority.
