[Alpha Biz= Reporter Kim Sangjin] Chief Judge Kim Si-cheol of the Seoul High Court, who presided over the second trial in the divorce case between SK Group Chairman Chey Tae-won and Noh So-young, director of the Art Center Nabi, where a settlement of 1.3 trillion KRW in asset division and 2 billion KRW in alimony was ordered, has suggested that the upper limit on divorce compensation should be reconsidered.
According to legal sources on the 13th, Judge Kim made this argument in a presentation titled "Constitutional and Legal Issues Regarding Compensation Claims in Divorce Cases When the At-Fault Spouse's Divorce Request is Granted" at a Supreme Court Family Law Research Seminar.
Judge Kim pointed out that, as of 2023, the compensation awarded in divorce cases rarely exceeds 50 million KRW. He attributed this to the long-standing practice since 1991, where compensation in divorce cases has been influenced by the standards used in car accident compensation claims.
Citing data, Judge Kim noted that while the compensation limit for traffic accidents increased from 30 million KRW in 1991 to 100 million KRW in 2015, the average compensation for divorce cases rose only slightly, from 23.05 million KRW in 1991 to 24.16 million KRW in 2014.
