Lululemon Sues Costco Over Alleged Copycat Apparel Designs

[Alpha Biz= Kim Jisun] June 30, 2025 – California, USA — Lululemon Athletica has filed a lawsuit against Costco Wholesale in U.S. federal court, alleging that the retail giant infringed on its product designs and brand image by selling lookalike versions of Lululemon’s signature apparel at significantly lower prices.



According to the 49-page complaint filed on May 27 in California, Lululemon claims that Costco’s Kirkland Signature products closely mimic the design and trade dress of popular Lululemon items such as the Define Jacket, ABC Pants, and Scuba Hoodie.



The lawsuit accuses Costco of violating trade dress protections, which cover the overall appearance, look, and feel of a brand’s products. Lululemon emphasized that the similarities between the products are likely to cause consumer confusion and damage the company’s reputation.



For example:

Lululemon’s ABC Pants retail at $128, while Costco’s alleged dupe is priced at $19.90.

The Define Jacket (also $128) has a comparable Costco product selling for $21.90.

The Scuba Hoodie ($119) reportedly has a $8 lookalike at Costco.



The company also cited social media evidence, including widespread use of the hashtag #LululemonDupes, as proof that consumers are recognizing and promoting Kirkland items as cheaper alternatives to Lululemon originals.



Lululemon is seeking injunctive relief and damages, claiming Costco’s actions constitute unfair competition and brand dilution.
