[Alpha Biz=(Chicago) Reporter Paul Lee] An appeals court will announce on the 2nd a wage suit filed by former and current employees of E-Mart against the company, claiming they did not receive holiday work allowances.
According to the industry on the 1st, the Civil Affairs Agreement Department 15 of the Seoul High Court will hold an appeal date for a wage claim lawsuit filed by 1,117 former and current employees of E-Mart against the company in the afternoon of the next day. Three years and six months after the employees filed the lawsuit, the appeals court has been hearing the case since August last year.
Earlier, E-Mart employees filed a lawsuit, saying the company did not pay about 60 billion won in holiday work allowances from August 2017 to December 2020. Under the Labor Standards Act, the company is required to pay 150% of ordinary wages during holiday work, but they argue that the company has been required to use a one-day alternative holiday through consultation with illegitimate workers' representatives and reduced labor costs by paying only 100% of wages.
However, the first trial court rejected the employees' claims. The court ruled, "It is reasonable to believe that the management has implemented a legitimate holiday replacement system."
