[Alpha Biz= Kim Jisun] Cable & System, the leading company in the domestic cable industry, has won the second-round ruling in its patent infringement lawsuit against Daehan Electric Wire, following its victory in the first instance. Daehan Electric Wire is considering whether to appeal the decision after reviewing the court's judgment.
On Thursday, the 24th Division of the Patent Court (Chief Judge Woo Seong-yeob) partially upheld LS Cable & System's claim in the second-round lawsuit for patent infringement and damages, while rejecting Daehan Electric Wire's claims.
The court largely maintained the first-instance ruling but overturned the lower court’s judgment, which had ordered Daehan Electric Wire to pay approximately 490 million won to LS Cable & System. Instead, the court increased the damages to around 1.5 billion won. Furthermore, it ordered the disposal of related finished and semi-finished products stored at Daehan Electric Wire's headquarters, business offices, and sales offices.
The lawsuit began in August 2019 when LS Cable & System filed a lawsuit against Daehan Electric Wire, claiming that its bus duct joint kits, used in distribution equipment, infringed LS Cable & System’s patent. LS Cable & System had patented a third-generation bus duct and outsourced the production of joint kits to a subcontractor the following year.
The employee of that subcontractor later moved to Daehan Electric Wire in 2011, and LS Cable & System alleged that Daehan Electric Wire began producing similar products, raising suspicions of technology leakage.
In the first trial at the Seoul Central District Court, LS Cable & System won the case, with the court ordering the disposal of the infringing products and awarding damages of about 490 million won out of the 4.1 billion won that LS Cable & System had claimed. Both parties appealed: LS Cable & System argued the damages were too low, while Daehan Electric Wire claimed it had not infringed on the patent at all.
