[Alpha Biz= Kim Jisun] Kakao Pay has filed an administrative lawsuit challenging the sanctions imposed by the Personal Information Protection Commission (PIPC) for allegedly sharing customer data with Alipay, an entrusted service provider affiliated with Apple, without user consent.
According to Kakao Pay on Thursday, the company filed the lawsuit in January in response to the PIPC’s decision to impose a corrective order and an administrative fine.
The PIPC previously levied a fine of 5.968 billion won (approximately $4.4 million) and issued a corrective order, claiming that Kakao Pay had transferred the personal information of about 40 million users to Alipay without proper consent, violating regulations on overseas data transfers.
In its defense, Kakao Pay argued that the data was entrusted to Alipay as part of a legitimate outsourcing arrangement for fraud prevention services used within Apple's platform, and therefore complied with legal standards for data processing delegation.
